Who runs the Folly#
Fink's Folly is run by its makers (“we” below). To ask anything about these terms, a payment or your data, write to @finksfolly on Hive. With a payment, give its order id (it starts ff-) or its transaction id.
An unofficial fan game#
The Folly is an unofficial fan project set in the world of Splinterlands. It isn't made, endorsed or supported by Splinterlands, and isn't affiliated with it. Splinterlands, Praetoria and their characters belong to Splinterlands. Hive, Hive Keychain, DEC and SPS are run by others, under their own terms.
Playing#
- Playing is free. You play with a Hive account, signed in with Hive Keychain; signing in proves the account is yours, and posts or spends nothing.
- Your @name is public in the game: on the Chronicle's boards, the live feed, visits to your crag and, if you give, the Benefactors' Book.
- Don't try to break the game, get around its limits, or get at anyone else's crag. We may limit or close an account that does.
- What you earn in the game (aether, brass, glass, insight, renown, seals, relics and the rest) is part of the game: it has no cash value, can't be sold or exchanged, and isn't a token on any chain.
What's for sale#
Three kinds of thing are for sale, all for DEC:
- A gift to the Folly (5,000 DEC, 10,000 DEC, 20,000 DEC, 50,000 DEC). Gifts add up: your total raises a plaque on your crag, plays a scene of thanks the first time it reaches each tier, and lists you in the Benefactors' Book.
- A piece from the Gobson Exchange (500 DEC (small), 1,000 DEC (medium), 1,500 DEC (large)): an ornament for your crag, two on the stall each week.
- A commissioned room (5,000 DEC or 10,000 DEC): a show room, built free once commissioned, which you can put up, pack away and put up again.
Everything sold is cosmetic and in-game only. It pays no materials, renown, seals or probes, and doesn't change how fast the game goes. It belongs to your crag on the Folly: it has no cash value, isn't a token or an NFT, and can't be moved to another account, sold, or exchanged for money.
Prices are in DEC and set by the Folly's server when it makes out your order; the price in the panel is the price you pay. We don't sell or convert DEC, and what it's worth in money is up to the market, not us.
How paying works#
- You choose what to pay for. The Folly makes out an order with its price and an order id, which goes with the payment as its memo.
- Hive Keychain asks you to approve a transfer of DEC on Splinterlands to @finksfolly. Check the account, @finksfolly and the amount before you approve.
- A transfer is final once it's on chain. We can't reverse it; only a new transfer back can return it (see Refunds).
- The Folly credits your order once Splinterlands and the Hive chain confirm the payment: from your account, to @finksfolly, in DEC, for at least the price, with the order's memo. Your browser saying it was sent isn't enough, and each transaction is credited once, ever.
We never ask for your keys, for any token but DEC, or for a payment to any account but @finksfolly. The Handbook explains every step and what the panel shows while it waits.
Delivery at once, and the right to withdraw#
What you buy is delivered at once, the moment the payment is confirmed: the plaque goes up and its scene plays, the piece goes up on your crag, the commissioned room waits in your build menu.
In the EU and the UK, buyers of digital content usually have 14 days to change their mind. That right ends once delivery starts, if you've asked for it to start at once and agreed that you lose the right. The pay panels ask you to do that, with a box you tick before paying: by ticking it you ask for your purchase to be delivered at once and acknowledge that you then lose the 14-day right of withdrawal. Without it ticked, nothing can be paid for.
That doesn't touch what's below: a payment that can't be credited is always returned, and anything you paid for that wasn't delivered is put right.
Refunds#
Some payments can't be matched to an order or credited. The Folly never guesses: it credits nothing, and the payment is set aside for a person (the panel says “Being looked at”). That includes a payment that is:
- late (a Gobson Exchange piece's order lapses two hours after it's made, so its piece can't be bought after its week);
- a duplicate (the same order paid twice, or a second payment of anything);
- the wrong amount, token or recipient;
- for something your crag already holds (two orders that raced);
- from an account other than the order's, or with a memo that names no order;
- confirmed, but impossible to credit for a reason on our side.
Write to @finksfolly on Hive with the order id (the panel's “Your payments” lists it) or the transaction id. Within 14 days of hearing from you, we refund it in DEC to the account it was sent from or, where it can be and you'd rather, credit what you ordered. The refund's transaction is recorded against your order, and the panel shows it as “Refunded”. The same goes for anything you paid for that wasn't delivered.
A payment the panel shows as “Not paid” never moved: Splinterlands said the transfer didn't happen, so there's nothing to return. Nothing in these terms takes away rights the law gives you as a consumer.
Starting over#
Starting your crag over (Settings, Start over) clears the crag, but everything you paid for stays: your gifts' total and plaque, your place in the Benefactors' Book, the Exchange's pieces and your commissioned rooms, ready to put up again.
Test accounts#
A few accounts we name for testing play on a separate test crag, where everything is on sale at a thousandth of its price. Their payments are real DEC, checked exactly like any other, and these terms apply to them. A test crag is kept off every board, the feed and the Benefactors' Book, and can be reset at any time.
The Council standard#
The Council standard is a cosmetic reward in the game for holding staked SPS in Splinterlands (10,000 SPS and up): a standard by your crag's sign and a nightly crate of in-game brass and glass. The Folly only reads your stake from Splinterlands' public balances; it never moves, holds or asks for any SPS.
The standard and the crate are in-game only, with no monetary value. Nothing here is financial advice or a reason to buy or stake anything, and the Folly doesn't sell SPS.
If the game changes#
The Folly is a small project, offered as it is. Its rooms, story, prices and rules may change as it grows, and we can't promise it will always be available. We won't take back what you paid for while the game runs, and if the Folly is ever to close for good, we'll give notice on the site first.
Changes to these terms#
When these terms change, the new version and its date go at the top of this page. A change never applies to a purchase already made. If the terms of sale change, the pay panels ask you to tick the box again before your next payment.
